The Peabody Essex Museum (“PEM,” “the Museum,” “we,” “us,” “our”) is committed to protecting the privacy of its guests, visitors, members, and donors (“Users,” “you,” “your”). This privacy policy (“Privacy Policy”) describes how we collect, use and store information through our website (“www.pem.org“, “the PEM Website,” “Website,” or “the site”) and all corresponding subdomains and web pages associated with the foregoing URL.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data
The term “Personal Data” as used herein refers to data that can be used to identify you personally. PEM does not collect any Personal Data about individual Users unless such data is knowingly provided.

The Personal Data we collect may include:

  • (in the case of Members) any named joint Member

  • (in the case of patrons and other supporters) family and spouse/partner details

  • Current interests and preferences

  • Feedback you may have submitted related to PEM services and products

  • Ticket purchases and event registration/attendance details

  • Product selections and purchases of goods or services

  • Donations you have made to PEM

  • Contact preferences

Information about your employment history, educational background and other experiences

  • Purchase tickets for admission, concerts, or events

  • Purchase a membership or gift membership

  • Purchase a gift certificate

  • Purchase merchandise

  • Make a donation

  • Subscribe to a mailing list

  • Request information be sent to you

  • Complete a survey

  • Apply for a job, internship, or volunteer position

  • Communicate with us through the PEM Website, including the completion of any online forms

By knowingly providing Personal Data to PEM, whether by engaging in one of the activities above or otherwise, Users are consenting to PEM’s use of their Personal Data in accordance with this Privacy Policy.

Payment Data
When you purchase a ticket, membership, merchandise or other products, we need to know your name, billing and shipping addresses, telephone number, email address, and payment card data to process your order. Your payment card data will be used only as needed to process your transaction. You may decide whether or not to provide such information.

We do not have access to nor will we store your payment card details. That information is provided directly to our third-party payment processors whose use of your Personal Data is governed by their privacy policies. To our knowledge, these payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council. PCI-DSS requirements help ensure the secure handling of payment information. Please be advised, however, that the Museum does not control the privacy policies and practices of any third parties. Usage Data, Tracking Technologies and Cookies
Some usage data is collected automatically when you access the PEM Website.

Some content or applications, including advertisements, on the PEM Website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. Use of Your Personal Data
PEM uses the Personal Data you provide to us for internal purposes, such as filling and tracking your purchases, analyzing trends and collecting statistics. PEM may also compile and provide aggregate statistics about our visitors, customers, sales and related site information to third parties, but these statistics will not include any Personal Data. To the extent we combine any non-Personal Data with Personal Data, we will treat the combined product as Personal Data.

PEM may contact you by mail, phone or email to inform you of an event or promotion that we believe would interest you. We may combine Personal Data you give to us online, in our stores or when on-site at the Museum. We may also combine this information with publicly available information and information we received from or cross-reference with our third-party vendors and others. We may use this combined information to enhance and personalize your experience with us, to communicate with you about products or events that may be of interest to you, to communicate about fundraising projects and other special initiatives, or for other promotional purposes.

PEM may disclose Personal Data when such disclosure is reasonably necessary to comply with the law; enforce the terms of any of our user agreements; or protect the rights, property, and safety of PEM, the users of its site, or others. We also reserve the right to share the information that we collect with our subsidiaries and affiliates ‎and with any subsequent owner in the event of a merger, consolidation, sale of our assets, or other ‎change in our business.

If you purchase a ticket via the PEM Website to, or otherwise participate in, an event or promotion that we conduct jointly with another organization or company, we may share certain Personal Data collected from you, such as your name, address and email address, with the relevant organization or company.

PEM may from time to time retain qualified third-party vendors in order to help us manage the PEM Website and allow us to better serve our visitors and customers. These may include third-party vendors we engage to analyze the data we collect on the PEM Website, provide payment card processing, data management, promotional services and other services. We provide these service providers with the data they need to perform these services.

In addition to the foregoing, your information may also be used for the following purposes:

Retention of your Data

PEM will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the PEM Website and related services, or we are legally obligated to retain this usage data for longer time periods.

Opting Out Options

Marketing and Promotional Communications
You can unsubscribe or opt out of receiving marketing and promotional communications by either following the specific instructions included in such communications or by sending an email to us at privacy@pem.org detailing your privacy request.

Please note that opt-out and unsubscribe requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your information shall remain subject to the prior privacy settings.

Additionally, you should be aware that any information provided to third parties prior to your election to opt out or unsubscribe cannot be retrieved or rescinded by us unless required by applicable law, and you cannot retroactively opt out or unsubscribe with respect to such third parties.

We may still send you emails regarding changes to our policies and/or the features and functionality of PEM Website or in connection with a purchase via the PEM Website or other purposes specifically relating to your account and/or use of the PEM Website.

We may also have features that allow you to submit information, questions or feedback to us. In those instances, we may retain your emails and other information you submit to us for purposes of responding to you, for our internal purposes, and to help us to serve you better.

Opting Out Of Certain Tracking Technologies
You may limit or opt out from the collection of certain information for interest-based advertising uses and the use of certain Tracking Technologies as follows:

  • Collection of Information by Third-party Advertising Providers: To limit or opt out from the collection of your web viewing data for interest-based advertising uses, go to the DAA’s Consumer Choice Page, located at: http://aboutads.info/choices

  • Cookies: Most browsers are initially set to accept and allow local storage, but you should be able to change your settings to notify you when a cookie is being set or updated, local storage is being used, and/or to block cookies and/or the use of local storage altogether. Please consult the “Help” section of your browser for more information. Please note that by blocking any or all cookies you may not have access to certain features, content and/or other personalization available through the PEM Website.

  • Do Not Track Signals: Certain browsers transmit “do not track” signals to the websites that such browsers communicate with; however, this feature, and how it is used and activated, varies from browser to browser. Therefore, it is not clear whether the signals are intentionally transmitted by a user, or whether a user is even aware of this. Despite current efforts, there is still disagreement among leading Internet standards organizations, industry groups, technology companies, and regulators, concerning what, if anything, websites should do when they receive such signals, and no standard has been adopted to date. Because there is not yet a common understanding of how to interpret DNT Signals, nor a common definition of “tracking,” we do not currently respond to DNT Signals on the PEM Website.


User Submissions

The PEM website may offer bulletin boards, chat rooms, or other public forum-type features that enable you to post information, comments, computer file uploads, recommendations, ratings, personal web logs (blogs) or other information.

If you elect to post information to the PEM Website, you should be aware that any Personal Data that you submit there can be read, collected, or used by other users of these features, which are open to the general public. Any identifiable information could be widely disclosed, posted elsewhere on the Internet, or used to contact you or send you unsolicited messages.

We are not responsible for the Personal Data you choose to submit in these forums and urge Users to exercise caution before publicly posting any personally identifiable information.

Children’s Privacy

PEM does not knowingly collect Personal Data from people under the age of majority in their jurisdiction. Visitors under the age of majority in their jurisdiction should remember that they are required to obtain an adult’s permission before submitting any Personal Data to this or any other website.

If your child is under the age of 13 and has submitted Personal Data and you would like to request that such information be removed, you may contact us via one of the contact methods described in this Privacy Policy and we will promptly remove such information and shall not use such information or include it in our database.

Users 13 and under and their parents or guardians are advised that any Personal Data voluntarily entered by children may be available for use until PEM becomes aware that a User is under the age of 13 and has had a reasonable opportunity to remove the information.

Security

PEM takes reasonable steps to protect the security and integrity of all Personal Data. However, PEM cannot guarantee that your Personal Data will be absolutely safe from intrusion by others, and PEM will have no liability for disclosure of your information, including Personal Data, due to errors or unauthorized acts of third-parties during or after transmission.

It is important for you to protect against unauthorized access to your password and to your computer. PEM shall not be liable for the transfer or use of any Personal Data resulting from loss or distribution of data, the corruption of storage media, power failures, natural phenomena, riots, acts of vandalism, sabotage, terrorism or any other event beyond PEM’s reasonable control.

PEM reserves the right to change or update this Privacy Policy, or any other of the Museum’s policies or practices, at any time. The Museum’s posting of such changed or updated Privacy Policy on this page shall constitute notice to Users of the changes or updates.
